1. Agreement to Terms
By accessing or using the Skyline Treats platform (website or app), you agree to be bound by these Terms and Conditions. If you do not agree, please do not use our platform.
2. Account Registration
- You must be at least 18 years of age to create an account and place orders.
- You are responsible for maintaining the confidentiality of your login credentials.
- You must provide accurate, current and complete information during registration.
- You may not use another person's account without their permission.
- We reserve the right to suspend or terminate accounts that violate these terms.
3. Orders and Payment
- All orders placed through our platform are subject to acceptance and availability.
- Prices are displayed in Kenyan Shillings (KSH) and are inclusive of applicable taxes.
- We accept payment via M-Pesa, debit/credit card, and cryptocurrency.
- Payment must be completed before your order is processed and prepared.
- We reserve the right to cancel any order due to pricing errors or availability issues, with a full refund.
- All sales are final once an order is confirmed and being prepared.
4. Delivery Policy
- Delivery is available for addresses within Nairobi and surrounding areas.
- Delivery is free for locations within 10 km of our restaurant (Tom Mboya Street, Nairobi CBD).
- For locations beyond 10 km, a delivery fee of KSH 25 per additional kilometre applies.
- Delivery times are estimates and may vary based on traffic, weather, and order volume.
- We are not liable for delays caused by circumstances beyond our control.
- You are responsible for providing accurate delivery address information.
5. Food Quality and Allergens
- Our food is prepared in a kitchen that handles common allergens including gluten, dairy, eggs, nuts, and soy.
- If you have food allergies or dietary requirements, please contact us directly before ordering.
- We make reasonable efforts to ensure food quality and hygiene standards.
6. Cancellations and Refunds
- Orders can only be cancelled within 5 minutes of placement, before preparation begins.
- Refunds for cancelled orders will be processed within 3–7 business days via the original payment method.
- If food is delivered in an unsatisfactory condition, contact us within 1 hour of delivery for resolution.
7. Intellectual Property
All content on this platform — including logos, images, text, and software — is owned by or licensed to Skyline Treats and is protected by Kenyan and international intellectual property laws. You may not copy, modify, distribute or use our content without written permission.
8. Prohibited Uses
You may not use our platform to:
- Place fraudulent orders or make false payment claims.
- Attempt to gain unauthorised access to our systems.
- Upload or transmit harmful code, spam, or malicious content.
- Harass, abuse, or harm other users or our staff.
- Violate any applicable Kenyan laws or regulations.
9. Limitation of Liability
To the maximum extent permitted by Kenyan law, Skyline Treats is not liable for any indirect, incidental, or consequential damages arising from use of our platform or services. Our total liability in any matter is limited to the value of the order in question.
10. Governing Law
These Terms are governed by the laws of Kenya. Any disputes shall be resolved in the courts of Nairobi, Kenya.
11. Changes to Terms
We may update these Terms from time to time. We will notify you by updating the "Last updated" date. Continued use of the platform constitutes acceptance of the updated Terms.
